OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in San Bernardino County, California, and you consent to the personal jurisdiction of those courts.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.

Material changes will be communicated through reasonable means, which may include posting an updated version on this page. These Terms, along with the Privacy Policy and any applicable Client Agreement, constitute the entire agreement between you and TGT Investment Group regarding the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms freely.
